The Labour Chamber of the High Court of Justice of Catalonia has rendered an innovative decision that resolves resource for widow’s pension rights in cases of marital reconciliation.

In essence, the appeal argues that people divorced or legally separated, to cause the widow’s pension should be the alimony creditorreferred to in Article 97 of the Civil Code, a requirement that the plaintiff has not established and whose accreditation not releasesreconciliation of the couple, which is not legally formalized.

For reconciliation of separated spouses becomes effective in the recognition of the widow’s pension, it must be able to communicate(reconciliation) to court, as required by Article 84 of the Civil Code.
